Exemptions in Ontario

  • Units first occupied after November 15, 2018 are exempt from rent control (unless the tenant moved in before that date)
  • Community housing, care homes, and commercial tenancies
  • Vacant units (new tenants may be charged any price)
  • Landlords may apply to the LTB for above-guideline increases (AGI) for capital expenditures or extraordinary utility costs

Ontario publishes an annual rent increase guideline (2.1% for 2026, 2.5% for 2025). Landlords must give 90 days' written notice (Form N1) before the increase takes effect. Only one increase per 12-month period is permitted.
